During the Spring of 1998, appellant was tried by a general court-martial composed of officer and enlisted members at Fort Lewis, Washington. Contrary to his pleas, he was found guilty of kidnapping and forcibly sodomizing CM, in violation of Articles 134 and 125, Uniform Code of Military Justice, 10 USC §§ 934 and 925. On June 19, 1998, he was sentenced to a bad-conduct discharge, confinement for two years and six months, total forfeitures, and reduction to pay grade E-l.
