The defendants move for an order pursuant to subdivision 1 of section 344 of the Code of Criminal Procedure, removing the retrial of the indictment herein from the County Court of Rockland^ County to a term of the Supreme Court to be held in the same county. The Special District Attorney *161does not oppose the application, nor does he consent thereto.
