The defendant, a captain of police, has been indicted upon the charge of willfully neglecting to suppress a disorderly house within his precinct in the city of Hew York, and he makes this application for the removal of the trial of the action from the Court of General Sessions of the Peace in and for the city and county of Hew York, “to the Supreme Court of the State of Hew York in another county of said State, to be selected by the Supreme Court as -a county where a fair and impartial trial thereof can he had, and to .have the said indictment in the *73criminal action founded thereon removed…
