Defendants Cumberland County and Key Risk Management Services appeal from an opinion and award of the North Carolina Industrial Commission concluding that plaintiff Day’le Lathon is entitled to workers’ compensation benefits as a result of carpal tunnel syndrome plaintiff developed while working for defendant Cumberland County. On appeal, defendants argue that the Commission’s opinion and award is void because it was filed after the terms of two of the commissioners on the panel deciding plaintiff’s case had expired.
