This matter is before the Court on the plaintiffs’ motions for summary judgment as to Counts I, III, and V and the defendants’ motions for summary judgment as to Count I, II, III, and V. For reasons stated below, the Court grants the defendants’ motions as to Counts I and II, grants in part and denies in part defendants’ motion as to Count III, denies the defendants’ motion as to Count V, and denies the plaintiffs’ motions as to Counts I, III, and V.
