Count 1 of the petition in this case alleged in substance that the defendant entered into an oral contract with the plaintiff to sell to him certain described real property located in Gwinnett County (setting out in the petition a description thereof); that on the date the parties entered into the contract the plaintiff paid to the defendant the sum of $200 to apply on the purchase price of said property and received from the defendant a written receipt therefor as follows: “Received from J.
