BROOKS, Judge.
Appellant was convicted of murder in the first degree, and his punishment assessed at death.
The substance of the evidence, in reference to the homicide, is as follows: The State’s case was made' out by circumstantial evidence.
The theory of the State being that the defendant made preparations to leave home on Wednesday before the killing on Saturday night, and his purpose in advertising that fact was to account for his absence at the time of the killing.
