PRENDERGAST, Presiding Judge.
Appellant was convicted of the burglary of a box car. The uncontroverted testimony shows that on the night of August 16, 1914, a box car in charge of the agent of one of the railroads running into Waco was burglarized and a large amount of merchandise stolen out of it at the time. Some of said merchandise was found in and above the ceiling of the building of the railroad company, used by appellant and other employees. Also others of the goods were found in another place. M. L.
