In this action, the appellees sued the appellant, as a common carrier of goods for hire, in the Allen Circuit Court, in' a complaint of two paragraphs. On the appellees’ application, the venue of the action was changed to the court below. In this latter court the appellees hied an amended second paragraph, and an additional third paragraph of their complaint. The appellant demurred to each paragraph of the appellees’ complaint, upon the ground that it did not state facts sufficient to constitute a cause of action, which demurrers were severally overruled by the court, and to these decisions…
