Plaintiff brings action to collect the proceeds of a Level Term Life insurance policy on the life of her deceased husband. On June 7, 1963, Clarence Rutten made application for the policy from the defendant, Investors Life Insurance Company of Iowa. The application was accepted and, premiums paid. The decedent died of cancer on September 8, 1963. First beneficiary, First National Bank of Le Mars, hereinafter referred to as the bank, has assigned its interest to second beneficiary, plaintiff Mrs. Rutten, deceased’s widow, who made proof of loss and application for the payment of the policy,…
