The appellant and defendant below, Elmer C. Underwood, at the time of the commencement of this action *563and for some years previous thereto, was a skilled and successful lawyer at the Louisville bar who enjoyed a wide and favorable reputation and lucrative practice. Underwood has died since the commencement of this action. Beckham Overstreet is a younger lawyer of good reputation and professional standing.
