MEMORANDUM

JUNE L. GREEN, District Judge.

I. Introduction

This case comes before the Court on the parties’ cross-motions for summary judgment. Because the Court finds that no “final agency action” has occurred in this matter, it will dismiss this case without prejudice.

II. Facts

The Plaintiffs are United States citizens who have been employed in the past and wish to be employed in the future as captains or crew on board tuna fishing vessels documented under the flags of Mexico, Venezuela and Vanuatu.
