This is a suit for personal injuries brought under the Federal Employers’ Liability Act by respondent which resulted in a verdict for respondent in the amount of $8,500.00. Appellant filed a motion for new trial which was by the trial court overruled on condition of remittitur of $2,000.00 with accrued interest thereon; alternatively, the trial court ruled that if such remittitur was not made, the motion for new trial would be sustained “on the ground that the verdict was the result of bias, passion and prejudice on the part of the jury against the defendant in favor…
