JOURNAL ENTRY AND OPINION
{¶ 1} Appellant Marc Glassman, Inc. ("MGI") appeals the decision of the Cuyahoga County Court of Common Pleas that granted appellees' motion to strike and the trial court's order which appeared to dismiss the case with prejudice. This court, sua sponte, remanded the case to the trial court to clarify its dismissal of September 16, 2005, because of a discrepancy in the record regarding whether the dismissal was with or without prejudice.
