O’KELLEY, District Judge.
On January 9,1975, plaintiff brought this action against his employer, defendant General Motors Corporation [hereinafter “General Motors”], under 42 U.S.C. § 2000e et seq. and 42 U.S.C. § 1981. On November 7, 1975, the court granted defendant’s motion to dismiss the complaint as a class action. On January 9, 1976, the defendant filed a motion for summary judgment.
