Affirming.

This is a suit brought under the Declaratory Judgment Act to test the constitutionality of chapter 84 of the Acts of 1928, and, if it be held to be constitutional, to ascertain how in certain respects it should be interpreted. Both the plaintiffs and the defendants are frankly in entire accord that the act is unconstitutional. This, too, is the opinion of the Attorney General, who was duly notified of the pendency of this action, as required by section 9 of the Declaratory Judgment Act (Civil Code, sec. 639a9).
