The defendant was found guilty by a jury in Superior Court of operating under the influence of liquor (GUI) and operating to endanger. Following the jury trial, the judge found the defendant guilty on an indictment charging that the GUI violation was the defendant’s third in the past ten years. *367On appeal, the defendant alleges, inter alia, error in the judge’s failure to allow his motion in hmine to exclude reference at trial to his prior bad acts, and in the admission of testimony that he at first refused to take a roadside sobriety test on the night of his arrest.
