1 vendor and contraUction ot written option, — Plaintiff is a real estate agent and broker, residing in the city of Des Moines, and brings this action to recover a real estate commission. He alleged in his petition that the defendant, on April 21, 1920, listed the southeast corner of Twelfth and Mulberry streets, 132 by 107 5/6 feet, in the city of Des Moines, with him for sale; that the price and terms of sale were in writing as follows:
