Appeal from special term', New York county. Action by Andrew Langdon, Sumner W. White, and Charles R. Heneage against the New York, Lake Erie & Western Railroad Company. It appears from the complaint that the plaintiffs, as copartners, were miners, shippers, and dealers in coal from the 1st of May, 1885, until September, 1889, when this action was commenced. The mines from which their coal was obtained were located in the region of the Carbondale, Lackawanna and Wyoming anthracite coal-fields, in the state of Pennsylvania.
