On July 26, 1901, at the July term, 1901, of the criminal court of Greene county, the prosecuting attorney of said county filed an information against Walter Wallace, charging him with steal*362ing a horse. The accused was arrested on the 23th day of July following, and gave a recognizance bond in the sum of five hundred dollars, with J. W. Wallace and A. J.
