— John J. Lamb was convicted of murder in the first degree with recommendation to mercy, and pursuant to the statute was sentenced to life imprisonment.

The judgment of conviction was affirmed by this court on writ of error at the last term. Lamb v. State, — Fla. 107 South. Rep. 530.

Before the mandate of this court was transmitted to the trial court, Lamb presented here a petition sworn to by himself and by his counsel, praying that he be granted the privilege of applying to the judge of the Circuit Court in which the trial was had and judgment of conviction rendered, for a writ of error comm…
