The question involved on this appeal is the effect of a sale of trust property by a trustee, under a will with the pówé'r óf sale, to himself individually. Tt arises in "this way:' J'ames M. Thomas died testate, a resident of Clark *201county, Kentucky, on June 15, 1905, and on the 24th day of the samé month his will was probated before the county conrt of that county.
