This petition was brought on July 21, 1970, pursuant to the provisions of G. L. 1956 (1970 Reenactment) §45-32-43, to assess damages for the condemnation of the plaintiff's property located on South Main Street in the city of Providence. A trial justice, sitting without a jury, awarded Mr. Corrado 1 $35,000 in damages plus interest. Thereafter Mr. Corrado filed a motion for a new trial based upon alleged newly discovered evidence.
