WEISBERGER, Chief Justice.

This case came before us on appeal by the defendant, Joseph Gabriau (Gabriau), from a judgment of conviction entered in the Superi- or Court for the County of Providence upon a jury verdict finding him guilty of two counts of first-degree sexual assault in violation of G.L.1956 § 11-37-2 and one count of second-degree sexual assault in violation of § 11-37-4. After denying the defendant’s motion for a new trial, the trial justice sentenced him to forty years, with twenty to serve, twenty suspended, and twenty years’ probation, on each of the first-degree…
