Thomas M. Conrad has brought suit against Reliance Standard Life Insurance Company (“Reliance”) to challenge its decision to deny his claim for long-term disability benefits. Conrad was a beneficiary under an insurance policy issued by Reliance to NitroMed, Inc. (“NitroMed”), Conrad’s former employer. Because the policy was part of an employee welfare benefit plan, it is governed by the Employment Retirement Income and Security Act of 1974 (“ERISA”), 29 U.S.C. §§ 1001 et seq.
