Tbis suit was filed on January 7, 1930, by tbe Sinton State Bank against Gust Tsesmelis to recover upon a promissory note for $725 with 10 per cent, interest from its date and tbe usual 10 per cent, attorney’s fees.
Simultaneously with the filing of tbe suit, a writ of attachment, predicated upon affidavit and bond therefor, was issued and levied upon a lot in Sinton, Tex., and a farm near Sinton, belonging to Tsesmelis.
