OPINION

CHÁVEZ, Justice.

{1} This case is on appeal solely to determine whether it is a “pending” case for purposes of the procedural rule change announced in State v. Savedra, 2010-NMSC-025, ¶ 9,148 N.M. 301, 236 P.3d 20. Savedra eliminated portions of Rule 5-604 NMRA (“the six-month rule”) effective for all cases pending in district court as of the date Savedra was filed.
