PELLEGRINI, Judge.

Charles K. Herbert (Herbert) appeals his summary conviction by the Court of Common Pleas of York County (trial court) for violating Ordinance No. 1984-01 of the Borough of Stewartstown (Ordinance), as amended by Ordinance No. 1987-003, -by failing to connect to the Borough water system.

Herbert purchased property in Stewartstown in 1929. At the time of the purchase, the existing house was connected to a privately owned and operated water system. In 1962, he voluntarily disconnected his residence from the system because of concerns about the quality of the water. A private…
