In this action United Engineering & Foundry Company (hereinafter referred to *597as “United”) as cross-plaintiff filed its cross-complaint, supplemental and ancillary to the suit in Equity No. 2991, now pending in this Court, between the parties hereto, against the Cold Metal Process Company as cross-defendant (hereinafter referred to as “Cold Metal”).
