This action arose out of a Missouri Department of Transportation (“MoDOT”) project to expand highway 60 in Howell County from a two-lane to a four-lane highway. In connection with that project, the Missouri Highways and Transportation Commission (“the Commission”) initiated an action to condemn 3.4 of approximately 10.8 acres of land (“the taken land”) owned by John Dale (“Appellant”).
