This appeal involves the scope of the superior court’s appellate review under the Land Use Petition Act (LUPA), chapter 36.70C RCW. King County (County) and the Department of Ecology appeal the trial court’s order in this LUPA action. Stephen and Sandra Klineburger appealed a code enforcement order. The county hearing examiner affirmed the order, concluding that the County did not have the authority to disturb Ecology’s determination that the Klineburgers’ property did not qualify for an exception to state regulations prohibiting construction in a designated floodway.
