This is an appeal from the district court of Garfield county, wherein plaintiff in error, Dan Smith, hereinafter referred to as defendant, was convicted of the crime of seduction, and sentenced to pay a fine of $500 and to be confined in the county jail for a period of 80 days. Judgment was rendered on the 2d day of January, 1918, from which judgment'defendant appealed by filing in due time in this court his petition in “error with case-ma£e attached.
