The plaintiff in error, hereinafter referred to as the defendant, was convicted of the crime of manslaughter in the first degree, and sentenced to serve a term of four years in the state penitentiary a,t McAlester.

The testimony on behalf of the state in substance is as follows: The defendant and Jack Johnson attended. a dance and supper at the home of C.
