ELDRIDGE, Judge.
Gilbert James was shot and killed during the commission of an armed robbery which occurred on January 11,1998, at a Flash Foods convenience store in Albany. Mr. James’ wife, appellant/plaintiff Teresa L. James, individually and as administrator of his estate, filed the instant wrongful death action against appellee/defendant Flash Foods, Inc., seeking compensatory and punitive damages.
