Winston Lawrence, a union member, alleges that his employer, and specifically its CEO and Lawrence’s direct supervisor, discriminated and retaliated against him in violation of several federal and New York state statutes. The sole issue on appeal is whether the collective bargaining agreement (“CBA”) contains a “clear and unmistakable” waiver of Lawrence’s right to pursue his statutory claims in federal court.
