On March 28, 2013, Ms. Ina Scanlon filed a petition for compensation under the National Childhood Vaccine Injury Act of 1986, Pub.L. No. 99-660, § 311,100 Stat. 3743, 3755 (1986) (codified, as amended, at 42 U.S.C. §§ 300aa-l to -34 (“Vaccine Act”)), alleging injury resulting from receipt of the varicella zoster (“shingles”) vaccine. On September 27, 2013, the special master assigned to the case granted the government’s motion to dismiss on the ground that the shingles vaccine is not covered under the Vaccine Act.
