Plaintiff Tina Roberts brought this action pursuant to the Family and Medical Leave Act (“FMLA”), 29 U.S.C. §§ 2601 et seq., the New York State Human Rights Law, EXEC. LAW §§ 296, et seq. (“NYSHRL”) and the Consolidated Omnibus Budget Reconciliation Act of 1985, 29 U.S.C. §§ 1161, et seq. (“COBRA”) against her former employer, defendant Group Handling, Inc. (“GHI”).
