The only material question for review in this case is whether or not the property in controversy was in fact the homestead of Dr. Vick at the time the pavement assessment lien or mechanic’s lien for pavement work of the defendant in error arose. The uncontradicted evidence shows that Dr. Vick bought the land in question from Clara Schulz, who reserved a vendor’s lien to secure a part of the purchase price, and that at the time he bought the property he was married, with adult children, all of whom were married and constituted no part of his family.
