NOWLIN, District Judge.
This cause came before the Court on remand from the Fifth Circuit Court of Appeals for a trial on the merits. On July 22, 1986, Plaintiffs filed their Complaint in this Court seeking declaratory and injunctive relief. The Defendants timely answered, and on October 1, 1986, the Plaintiffs filed their motion for partial summary judgment. The Court granted the motion for partial summary judgment on January 27, 1987, which was published as Missouri Pacific Railroad Co. v. Railroad Commission of Texas, 653 F.Supp. 617 (W.D.Tex.1987), and the Defendants appealed. The…
