This case raises issues concerning the nature of proof necessary to obtain a commercial use variance, and the validity of the Exeter zoning ordinance. Plaintiff is the owner of property located on the corner of Lincoln and Front Streets in Exeter. The property consists of a 26-room wood house and an unattached barn, which is presently used for storage. Since 1953, the plaintiff has lived in this house and has operated a funeral parlor on the bottom floor and rented apartments on the upper floors.
