MEMORANDUM AND ORDER

GARBIS, District Judge.

The Court has before it Defendant United States’ Motion to Dismiss. The Court has considered the legal memoranda submitted by the parties and finds a hearing unnecessary to resolve the motion.

I. INTRODUCTION

According to the Complaint, on May 25, 1991, Plaintiff Wayne Ammer (“Ammer”) was allegedly operating a fishing vessel on the Pamlico Sound, in North Carolina, when he was thrown and injured by the wake of a passing U.S. Coast Guard (“USCG”) cutter which was proceeding in a negligent manner.
