On February 21, 1911, the defendant in error, plaintiff below, commenced this action in the superior court of Oklahoma county, agáinst the plaintiff in error, defendant below, to recover the balance due him as commission in connection with the sale of certain real estate, known as Stander’s First addition to Oklahoma City, under a contract entered into between them on December 29, 1909.
