Appellant, Clayton Baker, a candidate on the Independent ticket, and appellee, James V. Stevenson, a candidate on the Republican ticket, were opposing candidates for the office of supervisor of the town of Otter Creek, LaSalle county, at an election held in that township April 7, 1931. The canvass of the votes showed that appellant had received 259 votes and that appellee had received 258 votes for that office.
