L. HAND, Circuit Judge.

St. Pierre, the respondent, appeals from an order of the district court, sentencing him for criminal contempt in refusing to answer a question put to him before a grand jury. He had refused to answer substantially the same question once before and had been sentenced to thirty days’ imprisonment; he appealed to this court, and we affirmed the. conviction because the record did not contain any evidence tending to prove that he had committed a federal offense.
