MEMORANDUM
GASCH, District Judge.
This matter is before the Court on plaintiff’s motion for attorneys fees under the Equal Access to Justice Act (“EAJA” or “the Act”), 28 U.S.C. § 2412(d). On March 30, 1989, this Court granted plaintiff’s motion for summary judgment, ordering the Immigration and Naturalization Service (“INS”) to adjudicate plaintiff’s application for adjustment of status within thirty days.
