McDOWELL, District Judge.
This is an action at law commenced in the corporation court of the city of Lynchburg, and removed to this court, on the ground of the nonresidence of the defendant. Process was issued on April 5, 1905, returnable to the May rules. The defendant, conceded to be a citizen and resident of Pennsylvania, was found and served with process in due time in this state.
