To address concerns raised in the motion for rehearing, we withdraw our earlier opinion and judgment issued May 27, 1999 and substitute this one in its place. After a fire destroyed their home, appellees David and Barbara Pickens sued appellant Doyle Wilson Homebuilder, Inc. (“Doyle Wilson”) 1 and appellee Terry Maxwell Electric, Inc., for various causes of action related to the construction and sale of the house. A jury determined that neither defendant acted negligently, but found that Doyle Wilson breached two warranties and failed to comply with the home sale…
