Appellant Robert L. Codner hired Au-dino Construction Company (“Audino”) to act as general contractor on a construction project to build a residence on a lot owned by Codner. Audino hired appellee Roberto Arellano, doing business as Road Runner Concrete (“Road Runner”), as a subcontractor, to construct the foundation. When the completed house developed foundation and shifting problems, Codner sued Audino and Road Runner, alleging violations of the Texas Deceptive Trade Practices Act (“the DTPA”) and negligence.
