MEMORANDUM OPINION AND ORDER

ST. EVE, District Judge.

On August 19, 2004, a Grand Jury returned a multiple-count, second superseding indictment (the “Indictment”) against Defendant Muhammad Hamid Khalil Salah (“Defendant” or “Salah”) and his co-defendants. Currently before the Court is Sa-lah’s motion to dismiss Count II of the Indictment. For the reasons stated below, the Court denies the motion.
