This action came on for hearing before his Honor, Judge Townsend, at the November term of the Court of Common Pleas for the county of Barnwell, in the year 1899. At the hearing, the defendant demurred to the complaint upon the ground that the facts stated therein were not sufficient to constitute a cause of action.
